Litigation Funding

Property settlements can be incredibly stressful not just emotionally, but financially. The legal costs associated with a family law or de facto settlement can seem daunting and frustrating, particularly when you are aware that you are entitled to eventually receive settlement moneys when the process finishes. Litigation funding can provide a solution to this.

Following a relationship breakdown, you are seeking to move on with your life. This becomes hard with the added financial pressure of legal disputes regarding property settlement. Litigation funding allows you to pursue your legal entitlements while getting on with your life.

Litigation funding provides a lending facility at a time when financial resources can be stretched to their limit. The funding can be used to cover your legal costs, but also regular expenses such as school fees and general living expenses.

The lender requires payment at settlement, meaning there are no ongoing repayments to be made prior to settlement. Please note however that fees and charges will be payable on the loan at the end of settlement and will vary with each individual lender

Litigation funding can be a key tool in levelling the playing field during a property settlement. If you have experienced a relationship breakdown and feel you have entitlements but fear the costs of legally pursuing them, litigation funding may be the solution.

In the case of Redden & Mains [2010] FMCAfam 1338 (9 December 2010) this issue was addressed.  From the earliest orders relating to the parenting of the children in the matter, there had been an important, but often overlooked, order in place preventing the children from being immunised. It was the father’s evidence that he only consented to the Injunction to immunisation so he could begin spending time with his daughter.
